Captain Anatoly V. Shmelev, a former master-mariner, has being worked at the insurance market during last 14 years. Currently he is a deputy director - senior expert of Russurvey Ltd. in Minsk (Republic of Belarus) Independent Survey and Loss Adjusting Bureau

However almost everyone remembers and knows that Captain Anatoly Shmelev was the first Lloyd’s Agent in the Republic of Belarus.

He is a Chief of Research Group "Safe stowage and securing of cargoes" at the Scientific Centre "Freight Transportation Management“ of Open Joint-Stock company "Scientific and Research Institute of Motor Transport (NIIAT)"

The main aim of the website is drawing of the public attention to the necessity of prompt establishment of “Regulations on safety cargo stowage and securing on road transport”.

Practice shows that the cause of 70% of unsafe cargo transportations is inadequate cargo securing. Moreover, the cause of 40% of road accidents involving only one vehicle is the loss of control over vehicle due to shifting of the improper secured cargoes.

Clause 23.2 (twenty three point two) of Road Regulations stipulates that “Before starting and during movement a driver should control stowage, securing and cargo condition in order to avoid its falling and arising of difficulties for road traffic”.

The given clause is violated daily and everywhere due to lack of Regulations and methods of calculations of cargo securing.

The major part of drivers as well as forwarders has no any understanding on theory and methods of cargo securing.

There is no procedure of accidents investigations taking into consideration cargo stowage and securing. That’s why road police Officers do not consider cargo as a cause of road accident and as a result conclusions of investigations contain such simple explanations as “improper speed” and “driver did not manage to control driving of vehicle”. In the result of such conclusions the whole responsibility for road accident shifted to carrier: at the same time responsibility of Consignor for unsecure cargo is diluted.

We have brought repeatedly the issue of necessity of a specialized document stipulating cargo securing regulations similar to existing documents in foreign countries. Such standardized document is necessary for carriers and other legal entities. Only similar document would allow estimate compliance of clause 23.2 of Road Regulations by carriers.

We are of the opinion that Regulations on securing of cargoes transported on roads should stipulate:

1. Field of regulations and liability for violation of them;

2. Mechanical stresses affected the cargo during road transportation to be compensated by adequate securing;

3. Requirements to vehicles and existing securing systems.

4. Methods of typical cargoes securing.
